Terms of Service

1. Who we are, and what this is

Tank Tracker is a web application at tanktracker.ca operated by Ayres Capital Enterprises Ltd. ("Tank Tracker", "we", "us"), an Ontario, Canada company. These Terms are the agreement between us and you: the company that creates a workspace, and each person who signs in to it. By creating a workspace, paying for a subscription or using Tank Tracker you agree to these Terms and to our Privacy Policy. If you accept on behalf of a company, you confirm you are allowed to bind it. If you do not agree, do not create a workspace.

2. What Tank Tracker does, and what it does not do

Tank Tracker records what goes into your spray trucks' tanks at the fill dock: the dipstick reading, the water added, the mix you chose, the concentrate amounts calculated from the rates you entered, and the material cost you entered. It works offline on a shared tablet and syncs to your workspace when it has a connection. It reports product use and cost by truck, mix and period, and shows what is in every tank right now.

Tank Tracker is not a per-property application record, not a substitute for the records your regulator requires, and not a source of agronomic, safety or legal advice. Every calculation uses the tank capacities, mix rates and prices you enter; check them against the product label and your own judgement before you spray. You are responsible for the licences, records and reports your jurisdiction requires. We do not claim that Tank Tracker satisfies any regulation, and a Tank Tracker record is not a substitute for records the law requires you to keep at the property.

3. Your workspace and accounts

  • Each company gets its own workspace at its own web address (yourcompany.tanktracker.ca). The workspace and everything in it belongs to the company that paid for it.
  • Manager accounts are for people you trust with all of your workspace data: every manager sees everything and can invite other managers. Keep passwords private, use the idle lock on shared devices, and tell us at hello@tanktracker.ca if you think an account has been misused. You are responsible for what is done through your accounts and devices.
  • The technician page is a read-only link protected by a secret token. Anyone holding the link can see your fleet status. If it leaks, regenerate it in Settings → Tech Access.
  • You must be at least 18 and using Tank Tracker for a business.

4. Price, payment and renewal

  • The price is CAD $79 per month per workspace, plus applicable taxes, with unlimited trucks, tanks, products, mixes and users. If we offer other plans (for example an annual plan), the price and term shown at checkout apply.
  • You pay the first month by card through Stripe when you create your workspace. The workspace is created when that payment succeeds. There is no free period; the 30-day money-back guarantee in section 5 takes its place.
  • The subscription renews automatically every month and is charged to the card on file. Stripe emails your receipts. You can change your card or cancel in Settings → Billing, which opens the Stripe billing portal.
  • If a renewal payment fails, Stripe retries it for a while and the app keeps working. If the payment cannot be collected, the subscription ends and the workspace is locked until you subscribe again. Your data stays as described in the Privacy Policy.
  • We may change the price with at least 30 days' notice by email to the workspace's manager addresses. The new price applies from your first renewal after the notice takes effect. If you do not accept it, cancel before that renewal.
  • Prices exclude taxes. Stripe calculates and collects the tax that applies to your billing address. If you are tax-exempt, send us your exemption details before you pay.

5. 30-day money-back guarantee

If Tank Tracker is not right for you, email hello@tanktracker.ca from a manager address on your workspace within 30 days of your first payment and ask for a refund. We will refund that first payment in full to the card it came from, cancel the subscription and close the workspace. You do not need to give a reason. One refund per company. Refunds usually appear on your statement within 5 to 10 business days.

Outside that window, payments are non-refundable except where the law requires otherwise. Cancelling part-way through a month does not produce a partial refund; you keep access to the end of the period you have paid for.

6. Cancelling

You can cancel at any time in Settings → Billing or by emailing hello@tanktracker.ca. Your access continues until the end of the period you have paid for and no further charges are made. Export what you need before then (Settings → Data). After the paid period ends we keep the workspace for 12 months, so a seasonal fleet can come back in the spring with its history intact; you can ask us to delete it sooner at any time (Privacy Policy, section 6).

7. Your data

Your fills, trucks, products, prices, mixes, reports and every other record you put into your workspace are yours. You give us permission to host, process, back up and display that data to the people in your workspace, and to pass it to the service providers named in the Privacy Policy, only as needed to run Tank Tracker and support you. We do not sell your data and we do not use it for advertising.

We look at the contents of a workspace only when you ask us for help, when we are investigating a fault or misuse, or when the law requires it. We may use aggregated, de-identified statistics across all customers (for example, the number of fills logged per day) to run and describe the service; those statistics never identify you or your fleet.

You can export your data at any time as CSV or JSON from Settings → Data, and you can ask for a complete server-side copy by email.

8. Acceptable use

Use Tank Tracker for its purpose and within the law. Do not: try to access another company's workspace; probe, overload or interfere with the service; copy, resell, white-label or reverse-engineer it; upload anything malicious; or use it to store personal information the app does not ask for (for example, do not put your customers' personal details in notes fields). "Unlimited" means real use by a real fleet, not automated bulk loading. We may suspend a workspace that breaks these rules.

9. Availability, support and changes

We work hard to keep Tank Tracker up, but we do not promise uninterrupted or error-free service and we offer no uptime guarantee. The app is built to keep logging fills offline during an outage and to sync afterwards. We may take the service down briefly for maintenance and will give notice when we can.

Support is by email at hello@tanktracker.ca. We normally reply within one business day, Eastern time. We improve Tank Tracker continuously and may add, change or remove features. If we plan to remove something you rely on, we will tell you by email before we do.

10. Ending the agreement

You end it by cancelling (section 6). We may suspend or end your workspace if you break these Terms, if a payment cannot be collected, or if the law requires it. For a payment problem we lock the workspace first and you can unlock it by subscribing again. For serious misuse we may end access immediately. If we ever discontinue Tank Tracker altogether, we will give at least 90 days' notice by email and make sure you can export your data first.

11. Disclaimers and limits on liability

Tank Tracker is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that its calculations fit your products, equipment or regulations. We are not responsible for damage to turf, plants, property or people, for regulatory penalties, or for lost profits arising from mixes, rates, capacities or costs entered into or calculated by the service, or from data lost on your own devices.

Our total liability to you for anything arising out of Tank Tracker is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or gross negligence. You agree to cover us for claims that arise from your use of Tank Tracker in breach of these Terms.

Tank Tracker is sold for business use. If you are using it as a consumer, some of these limits may not apply to you under consumer protection law.

12. Governing law and disputes

If something goes wrong, email us first and we will try to sort it out.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and any dispute will be decided by the courts of Ontario.

13. Changes to these Terms

We may update these Terms. The current version is always at https://www.tanktracker.ca/terms.html with its effective date. For a material change we will email the workspace's manager addresses at least 30 days before it takes effect. Continuing to use Tank Tracker after that date means you accept the change; if you do not, cancel before it.

14. The rest

These Terms and the Privacy Policy are the whole agreement between us about Tank Tracker. If a court finds part of them unenforceable, the rest still applies. You may not transfer your workspace or this agreement to someone else without our written consent; we may transfer it to a successor that takes over Tank Tracker, and will tell you if we do. Notices to you go to the email addresses on your workspace. These Terms are written in English.
